STUDIO WEST PRODUCTIONS INC v. DOES 1-237, Case No. 4:12-cv-03690

Studio West Productions has filed suit against 237 John Doe defendants in the Southern District of Texas. Plaintiff’s attorney is John W. Raggio of The Raggio Law Firm, P.C., in Dallas, Texas.

Studio West alleges that the defendants pirated its motion picture using BitTorrent, In the Name of the King 2: Two Worlds (a/k/a “In the Name of the King: Two Worlds”).

Jurisdiction appears correct:

“[...] personal jurisdiction in this District and Division is proper because a substantial part of the tortious acts of infringement complained of herein occurred within the State of Texas, and within the Southern District of Texas, including this Division, and each Defendant:(a) may be found within the State of Texas; and/or (b) knew that its tortious activities would cause significant harm to Plaintiff in the State of Texas given the fact that Plaintiff distributed its motion picture through legal distribution channels throughout the entire state.”

The Plaintiff is a Canadian company, incorporated in BC:

“Plaintiff Studio West Productions Inc. is a company incorporated in the Province of British Columbia, with its principal place of business at 2400 Boundary Road, Burnaby, BC, V5M 3Z3, Canada.”
