Hard Drive Productions: Dirty Hands
SJD at the fightcopyrighttrolls.com site broke the news this morning that Hard Drive Productions has been sued in a brand new action in the District of Minnesota: Nathan Abshire v. Hard Drive Productions, 0:13-cv-00380-JNE-JSM. The Plaintiff is a former John Doe from Hard Drive Productions v. Does 1-1495 (see case page).
There are some simple facts about the since dismissed Hard Drive case in DC. I previously blogged that the work was apparently produced (according to the copyright registration) on the very same day it was first infringed (according to Hard Drive’s complaint). To quote myself..
… according to the copyright filing (reg. no. PA0001750487) for the video in this case, Amateur Allure – MaeLyn, the very first infringement occurred on the day of publication, 2011-05-27. What a coincidence!
In Nathan’s complaint, he raises the doctrine of unclean hands:
Hard Drive’s purported copyright on the Work is unenforceable or alternatively invalid, because, inter alia, the Work is ineligible subject matter for copyright, and is barred by the doctrines of unclean hands of Hard Drive and its agents and exhaustion.
Hard Drive may face even more litigation – this may not be the end of it.
